Terms and Conditions of Use for Living by Jewel Application

Welcome to Living by Jewel. These Terms and Conditions of Use ("Agreement") constitute a legally binding agreement between you as the user ("User" or "You") and DENNY SYAHPUTRA as the owner, developer, and service provider of the Living by Jewel application ("We", "Us", or "Our").

By downloading, accessing, and/or using the Living by Jewel mobile application ("Application") and the website livingbyjewel.id, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you are not permitted to use the Application.

1. Definitions

  • Application: The mobile application named "Living by Jewel" available on the Apple App Store and Google Play Store.
  • Services: All features, functionalities, content, and facilities provided through the Application or the Website.
  • User: Any individual or entity who downloads, registers, and uses the Application.
  • Payment Gateway Partner: The third-party financial transaction processing service provider cooperating with Us, officially licensed by Bank Indonesia.

2. Registration and Account Security

  • To use certain features of the Application, you must create an account by providing accurate, current, and complete information.
  • You are fully responsible for maintaining the confidentiality of your account credentials, including your username and password.
  • All activities occurring under your account are deemed to be performed by you. We shall not be held liable for any loss or damage arising from your failure to maintain account security.

3. Transaction and Payment Gateway Terms

  • The Application integrates with third-party Payment Gateway providers to process all digital payment transactions securely.
  • We do not store your sensitive credit card, debit card, or banking credentials directly. All financial data is encrypted and processed securely by our Payment Gateway Partner in accordance with industry security standards (PCI-DSS).
  • You agree to comply with the terms and conditions established by the respective Payment Gateway Partner during the transaction process.
  • We are not responsible for transaction failures, payment delays, or system errors directly caused by the Payment Gateway or the partner bank.

4. Apple App Store and Google Play Store Compliance

  • You acknowledge that these Terms and Conditions are an agreement between you and Us (DENNY SYAHPUTRA) only, and not with Apple Inc. or Google LLC.
  • The availability and license to use the Application are subject to the terms and ecosystem policies set by the Apple App Store and Google Play Store.
  • Apple Inc. and Google LLC have no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
  • In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual property rights, We (not Apple or Google) will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

5. Intellectual Property Rights

  • All logos, designs, source codes, text, graphics, features, and the trademark "Living by Jewel" are the exclusive property of DENNY SYAHPUTRA and are protected by applicable Copyright and Intellectual Property Laws in the Republic of Indonesia.
  • You are strictly prohibited from copying, modifying, distributing, reverse engineering, or exploiting any part of the Application without our prior written consent.

6. Limitation of Liability

  • The Application is provided on an "as is" and "as available" basis. We do not guarantee that the Application will always be uninterrupted, timely, secure, or error-free.
  • DENNY SYAHPUTRA shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your inability to use the Application or any system errors beyond our reasonable control.

7. Privacy Policy

  • The collection, storage, and processing of personal data you provide through the Application are governed by a separate document, the Living by Jewel Privacy Policy, which forms an integral part of these Terms and Conditions and is drafted in compliance with the Personal Data Protection Law (UU PDP) of Indonesia.

8. Governing Law and Dispute Resolution

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Indonesia.
  • Any disputes arising out of or in connection with the use of this Application shall be resolved amicably through consensus. If a mutual agreement cannot be reached, the dispute shall be settled through the competent District Court within our domiciled jurisdiction.

9. Amendments to Terms

  • We reserve the right to amend, modify, or update these Terms and Conditions at any time. Amendments will take effect immediately upon publication on the website page livingbyjewel.id/terms-and-condition.
  • Your continued use of the Application following any updates constitutes your acceptance of the new terms.
